Terms of Service

These Terms of Service ("Terms") govern your purchase and use of MadFishOne storefront packages and related services ("Services") provided by MadFish Solutions ("MadFishOne," "we," "us"). By purchasing a package or using this website, you agree to these Terms.

1. The Services

MadFishOne delivers fixed-price BigCommerce storefront builds. Depending on the package and build type you select, the Services include storefront design, build, and publication, store configuration, data migration from supported platforms, AI-assisted content generation, and a live concierge onboarding session. The specific features included in your purchase are listed on the package you select at checkout.

2. Pricing and payment

  • All packages are fixed price, payable in full at checkout. The price shown on your selected package at the time of purchase is the price you pay.
  • Payments are processed by Stripe on Stripe-hosted pages. We never receive or store your card details.
  • Optional add-ons offered during onboarding are priced as transparent line items and charged only with your approval, through the same secure payment flow.

3. Your responsibilities

  • Provide accurate business, contact, and store information during checkout and onboarding.
  • Maintain an active BigCommerce store/account (or authorize the creation of one) and grant the access needed to deliver the Services.
  • For migrations, provide valid access to your source platform and confirm the data selections you make in the onboarding wizard.
  • Ensure you have the rights to all content, branding, and product data you supply.
  • Attend the scheduled concierge onboarding session or reschedule with reasonable notice.

4. Delivery and ownership

  • Your storefront is delivered by publishing your finished theme to your BigCommerce store. Once published, the storefront is yours: you own and control your store, its theme, and your data.
  • The underlying component library, build tooling, and platform remain the property of MadFish Solutions. You receive a perpetual license to the finished theme as delivered to your store.
  • Content generated during onboarding (such as your About page and policy pages) is yours once published. You are responsible for reviewing generated content for accuracy before or promptly after launch.

5. Satisfaction guarantee

Every build is backed by our satisfaction guarantee: if your delivered storefront does not match what was configured and previewed during your onboarding session, we will correct it. Guarantee claims must be raised within 14 days of delivery.

6. Onboarding access links

After purchase, you receive a personal onboarding link by email. This link identifies your order. Keep it private. We may expire and reissue links for security reasons.

7. Acceptable use

You may not use the Services for unlawful products or content, to infringe the rights of others, or to attempt to access systems or data that are not yours. We may decline or refund a purchase that we cannot lawfully or practically fulfill.

8. Third-party platforms

The Services depend on third-party platforms (including BigCommerce, Stripe, and Calendly) that are governed by their own terms. We are not responsible for outages, changes, or actions of third-party platforms, including your source platform during a migration.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Services is limited to the amount you paid for the package giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost revenue.

10. Changes to these Terms

We may update these Terms from time to time. The version in effect at the time of your purchase governs that purchase. Material changes will be posted on this page with an updated date.
